Terms and Conditions for Club Rides including Waiver
Before a Ride
Club Rides take place on a Sunday, with routes published via email during the week prior to the scheduled ride. We also hold occasional rides, including on public holidays, and organise cycling trips to other areas of Victoria including an annual trip to Bright.
By participating in any ride organised by MRCC you are confirming that you have read and understood the Waiver below and agree to its requirements. You are also confirming you will ride responsibly and look out for those around you.
To participate in a ride organised by MRCC, you must:
- Be at least 17 years old – riders aged 16 years or under must be accompanied (either riding with the group or following in a vehicle) by a parent, guardian or sibling who is at least 18 years old.
- Be confident in your fitness, medical health and riding ability for the distance and elevation involved in the ride.
- Ensure your bike is road-legal, well maintained and has working brakes.
- Be self-sufficient with water, nutrition, a mobile phone and basic repair tools.
- Wear a cycling helmet that complies with Australian Safety Standards.
- Understand and follow all road rules and ride leader guidance.
The MRCC community is inclusive and encouraging. MRCC rides are social, not races. We ride together, regroup as needed and prioritise safety and respect at all times.
Waiver
Participation on rides organised by MRCC requires agreement to this Waiver, which affirms that you are medically healthy, fit and prepared for the ride; understand road rules; and will act responsibly and safely.
1. PARTICIPATION REQUIREMENTS
1.1 Compliance with Terms
By participating in a ride organised by MRCC, you agree to comply with these Terms at all times. If you do not agree, you must not participate. You also acknowledge that MRCC relies on information provided by you and that all information is accurate and complete.
1.2 Skills and Experience
You affirm that:
- You are at least 17 years old – if you are aged 16 or less you affirm that you are being accompanied (either riding with the group or following in a vehicle) by a parent, guardian or sibling who is at least 18 years old.
- You have the skills, medical health, fitness and experience necessary for the ride.
- Your bike is road-legal, well-maintained and has working brakes and suitable tyres.
- You can complete basic repairs (such as repairing a punctured tyre) to your bike unassisted.
- You will be self-sufficient with water, food, a taillight (and preferably also a front light) and a repair/tool kit.
2. ASSUMPTION OF RISK
Cycling is an inherently hazardous activity. You acknowledge that participation carries risks of injury, death or property damage. You assume full responsibility for all risks, whether known or unknown, and accept all associated costs and damages. You confirm that you have read and understand the risks associated with participation.
3. RELEASE OF LIABILITY
By participating in a ride organised by MRCC, to the extent permitted by law, including under relevant sections of the Competition and Consumer Act 2010 (C’wealth), you release and waive any claims against MRCC, its Committee, ride leaders, volunteers, and any affiliated entities (collectively, the “Released Parties”) for injuries, damages or losses arising from participation. This release applies whether or not the injury is caused by the negligence of the Released Parties. This release does not apply to liability arising from the reckless conduct of any Released Party.
4. INDEMNIFICATION
You agree to indemnify and hold harmless the Released Parties from any claims, damages, costs or expenses (including legal fees) arising from your participation in a ride organised by MRCC.
5. SAFETY & RESPONSIBILITIES
You agree to:
- Obey all road rules and traffic laws.
- Wear a bicycle helmet that meets current Australian Safety Standards.
- Carry a working mobile phone and appropriate identification.
- Follow the directions of ride leaders regarding speed, group riding behaviour, routes and safety measures.
- Accept full responsibility for injury, loss or damage associated with the consumption of alcohol or any other mind-altering substance.
If you suffer injury or illness, you consent to MRCC providing first aid. If you are involved in an incident and are unable to call emergency services, you authorise another participant or a member of the public to do so on your behalf and accept any costs incurred.
6. INSURANCE & LIABILITY
- You are responsible for your own insurance coverage.
- MRCC does not provide accident, injury or liability insurance.
- You acknowledge that other participants may or may not have individual insurance.
- If you do not hold suitable insurance, you may be personally liable for any losses.
7. RIDE GUIDELINES
Rides organised by MRCC are social rides, not races. Participants are expected to:
- Call out hazards and act in a manner which prioritises the safety of fellow riders.
- Regroup at key points and provide assistance if needed.
- Respect all riders, regardless of experience or bike type.
- Adhere to venue etiquette, properly storing bikes at cafes or other stops.
Aggressive or inappropriate behaviour, including violence, verbal abuse or littering may result in exclusion from rides or other activities organised by MRCC.
8. PHOTOGRAPHS
By participating, you grant permission for MRCC to use photographs taken during a ride organised by MRCC on social media platforms (such as Strava, WhatsApp and Facebook).
